Camp Livingston, Inc. Rental Agreement
This Agreement is entered into between Camp Livingston, Inc. and The Jewish Federation of Cincinnati (collectively “Camp Livingston”) and you, yourself and on behalf of your family (collectively “You” or “Participants”) for the 2024 Spring Family Camp from May 24th, 2024 through May 26th, 2024 (the “Event”) at Camp Livingston in Bennington, Indiana (the “Campus”).
CANCELLATION POLICY / FEES:
All fees must be paid at time of booking. Cancellation more than one month prior to the Event will result in a 25% administrative cancellation fee per family registration. Payment of 50% of the fee will be required from all cancellations that take place less than 1 month in advance of the Participants’ scheduled arrival. There will be no refunds for cancellations less than 48 hours in advance of the beginning of the Event. There are no discounts or refunds for early departures.
ACCOMMODATIONS:
The sleeping facilities during the Event will include for each person a bed and a mattress in a cabin. Each person will provide his/her/their own sheets, blankets, pillows, pillowcases, toiletries, etc. Camp Livingston will provide fully operational sink, shower, and toilet facilities, which will be cleaned and sanitized daily. All Participants shall adhere to all protocols, guidelines and requirements of Camp Livingston, Indiana, local health department, and/or the CDC in effect at the time of the Event for all sleeping facilities.
MEALS:
Camp Livingston will provide meals and snacks for the Event. As a Kosher facility, non-Kosher food (including snacks) may not be brought into the dining hall or kitchen at any time. Camp Livingston will provide meals for any participants requiring vegetarian, gluten-free, or other special dietary meals with advance written notice of at least 14 days prior to the arrival of the Participant. No dishes or equipment can be removed from the dining hall or any designated eating area. No food may be brought into living quarters at any time. Participant understands and agrees that use of dining facilities, food service, clean up, sanitization and related matters are subject to the protocols, guidelines and requirements of Camp Livingston, Indiana, local health department, and/or the CDC in effect at the time of the Event.
TELEPHONE AND INTERNET:
Camp Livingston has cell phone service (Verizon) throughout camp and has landlines in most areas of camp.
CAMPUS RULES, REGULATIONS AND PROHIBITIONS:
Drugs: Camp Livingston is a drug free campus. The possession, consumption, or use of drugs anywhere on Campus is not permitted. Any Participant found in violation of this policy will be removed from the Campus immediately.
Smoking: Camp Livingston is a smoke free campus. Under no circumstances are Participants allowed to smoke in any living/sleeping facilities on the Campus.
Hunting, Firearms, Fireworks: NO hunting, firearms, fireworks, ammunition and explosives of any nature are permitted anywhere on the Campus.
Fire: Open fires may be built only at the designated campfire area, and all fires during the Event shall be only built by staff of Camp Livingston. You agree to comply with all lawful orders of appropriate fire control officials.
Pets: No visiting pets are allowed onto the Campus at any time, provided however that trained service animals may be permitted upon prior written approval of Camp Livingston.
Hazardous Materials: All hazardous materials (e.g. gasoline, flammable liquids, poisonous substances) that a Participant plans to bring onto the Campus must be approved in writing in advance by Camp Livingston, and appropriate storage and security procedures arranged. Candles, incense or tea lights or any type of open flame are not permitted in any cabin or building.
Parking: In order to allow the movement of emergency vehicles throughout the Campus, all Participant vehicles must be parked in one of the designated parking areas. Parking in or around the cabins and program facilities is prohibited. All vehicles must be driven only on Campus roads and not on footpaths or other areas.
Off Limits Areas: You agree that you may not be in the lake or the pool without a lifeguard on duty and may not participate in any other activities such as ropes course/climbing wall during the Event unless such areas are designated as “open” and Camp Livingston staff is supervising the program area. If you are found to be in violation of this provision, Camp Livingston may ask you to leave the Campus.
EMERGENCY PROCEDURES:
Once at the Campus, Participants agree to attend a brief orientation to Camp Livingston’s safety regulations and emergency procedures. You agree that you and your family will at all times adhere to any and all Camp Livingston, Indiana and CDC guidelines or requirements (whichever is most restrictive, in effect at the time of the Event, and failure to do so may lead to your removal from the Campus.
GROUP/INDIVIDUAL AND PERSONAL PROPERTY:
Participant acknowledges that Camp Livingston accepts no responsibility for any personal property of the Participants, whether at the Campus or in transit to or from the Campus and any loss thereof.
MEDICAL, HEALTH AND SAFETY:
Camp Livingston does not provide health care services or staff, medical supervision, treatment, maintenance, or dispensing of medications for Participants during the Event and is not responsible for the health care of the Participants while at the Event. These responsibilities belong solely and exclusively to Participants. You consent yourself and on behalf of your family to any emergency medical response including medical transportation and hereby agree to indemnify, defend and hold harmless Camp Livingston for damages arising from the administration of an emergency medical response and all costs associated with emergency medical transportation.
Camp Livingston DOES NOT guarantee, warrant or represent in any way that COVID-19/Coronavirus infection, flu, or any other contagious health condition will not occur through your attendance at Camp Livingston or participation in its activities or by use of Camp Livingston facilities. You acknowledge that participation in group events and in outdoor activities in a natural, rustic environment with adventure activities such as a ropes course comes with inherent risks including, but not limited to, illness and injury, and other ramifications which may result due to exposure to and/or infection with viruses, fungus or bacteria. In assuming such risk, You understand, agree, accept and assume full responsibility for these risks and are not relying on all such risks to be described in this Agreement.
Anyone symptomatic, diagnosed by a healthcare provider or tested positive for COVID-19 or other contagious disease, or awaiting test results or other confirmation of COVID-19 or other contagious disease prior to coming to Camp Livingston will not be permitted entrance. Camp Livingston does not provide testing, and all costs and arrangements relating to obtaining a test is the responsibility of the Participant. Any Participant who becomes symptomatic of or is diagnosed as having COVID-19 or other contagious disease, must immediately notify Camp Livingston and quarantine in accordance with protocols in effect at Camp Livingston at the time, and will not return to activities or participation until permitted by a health care provider or health department.
ASSUMPTION OF RISK:
You and your family members bound by this Agreement have voluntarily chosen to participate in the Event and potentially inherently dangerous activities at the Event. You voluntarily, knowingly, and expressly assume the risks associated with participation in the Event as well as other risks not listed that are part of, related to, or arising from participation in the Event, and any harm, injury, illness, or loss that may occur to You and/or your family members as a result of Your participation in the Event or during any transportation to or from the Event including any injury or loss caused by the negligence of Camp Livingston, its employees, agents, and officers, its contractors, its vendors, and other event participants.
INDEMNIFICATION:
To the fullest extent permitted by law, Participant, itself and on behalf of Participant’s family members and other attendees he/she/they has registered including minor children, shall and does agree to defend, indemnify and hold harmless Camp Livingston, The Jewish Federation of Cincinnati, and each of their respective members, officers, directors, employees, agents and representatives (collectively, the “Indemnified Parties”) from and against any and all liability, losses, claims, damages, liens, causes of action, suits, judgments and expenses (including attorney’s fees and other costs of defense) (collectively “Losses”), of any nature, kind or description, which directly or indirectly arise from or are related to (a) Participants and his/her/their family’s participation in the Event or the breach of this Agreement or violation of any law, rule or regulation, or (b) bodily injury, personal injury, sickness, disease or death of any person, or to damage to or destruction of tangible property.
In consideration of the terms and conditions of this agreement Participant, itself and on behalf of his/her/their family and their respective heirs, representatives, executors, administrators, and assigns (“Releasors”), DO HEREBY AGREE TO FOREVER RELEASE, WAIVE, INDEMNIFY, DEFEND AND HOLD HARMLESS Camp Livingston, Inc. and its officers, directors, agents, employees and staff members, volunteers, insurers and representatives (“Releasees”) from any causes of action, claims or demands of any kind or nature whatsoever including, but in no way limited to, claims of negligence, which any Releasors may have now or in the future against the Releasees (individually or jointly) on account of or relating to loss, personal injury, property damage, disability, death, accident, viral/fungal/bacterial infection, sickness or disease, however occurring with respect to or from participation in the Event and/or use or access to the Campus and its facilities. Participant understands that it will be solely responsible for any loss or damage for, including but not limited to, personal injury, property damage, disability, accident, infection of any kind or nature, sickness or death sustained or resulting in any way from the use of or access to Campus and its facilities and/or participation in the Event.
LIMITATION OF LIABILITY:
Camp Livingston shall not be liable to Participant or its family for any special, consequential (even if Camp Livingston has been informed of the possibility of such damages), incidental, punitive or indirect damages, losses, costs or expenses of any kind or any lost or imputed profits arising out of this Agreement or the termination thereof, however caused, and whether based in contract, tort (including negligence) or any other theory of liability. Camp Livingston’s liability to Participant and its family shall not exceed the total amount of the fees paid hereunder.
GOVERNING LAW:
The rights and obligations of the parties under this Agreement shall be governed by and construed under the laws of the State of Ohio without reference to conflict of laws principles. Each party irrevocably consents to the exclusive personal jurisdiction of the state and federal courts located in Hamilton County, Ohio and agrees that any claim against the other arising from or in connection with this Agreement shall be brought in such courts.
On behalf of all of the members of Your family or group, You agree that You have read, understand and agree to abide by, the stated contract terms and conditions.
